Terms of Use

These Terms govern your use of the MushTrail mobile application. By installing or using the app you agree to these Terms. If you do not agree, please do not use the app.
1. Provider
MushTrail is provided by Nadzeya Yashchuk, a sole proprietor based in Wals-Siezenheim, Austria. Contact: contact@nadzeyayashchuk.com (see Impressum).
2. Safety notice — please read
MushTrail is a navigation aid, not a safety guarantee. It depends on your phone’s GPS, battery, sensors, and the accuracy of map data, all of which can fail or be unavailable. The compass and distance are estimates and may be affected by terrain, weather, magnetic interference, or a low battery.
Do not rely on the app as your only means of finding your way. Before going into the forest: tell someone your route, carry a charged phone (and ideally a power bank), and consider a physical map and compass. You are solely responsible for your own safety and decisions. The app must not be used where doing so is unsafe or unlawful.
3. Licence to use
We grant you a personal, non-exclusive, non-transferable licence to use the app for its intended personal purpose. You may not copy, modify, reverse-engineer, resell, or misuse the app, interfere with its operation, or attempt unauthorized access.
4. Free features and Premium subscription
Core navigation — recording your track and the “Home” arrow with distance to your entry point — is free. Optional MushTrail Premium unlocks trip history and unlimited saved mushroom spots (the free tier allows up to 5 saved spots).
- Premium is an auto-renewing subscription offered as monthly or yearly plans. Prices are shown in the app in your local currency and may vary by region and over time.
- Payment is charged to your Apple App Store or Google Play account. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
- You manage or cancel your subscription in your App Store / Google Play account settings. Any free-trial period, if offered, is forfeited when you subscribe during the trial where applicable.
- Refunds are handled by Apple or Google under their respective policies.
5. Your content
Tracks, notes, and mushroom spots you create are stored on your device and remain yours. You are responsible for backing them up; uninstalling the app or losing the device may delete them.
6. Availability
The app is provided on an “as available” basis. We may update, change, or discontinue features. Offline functionality depends on maps and data you download in advance.
7. Intellectual property
The app’s design, branding, copy, and original code are protected by intellectual-property laws and remain the property of the provider or its licensors. Map data is © OpenStreetMap contributors under its licence.
8. No warranty
The app is provided without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability.
9. Limitation of liability
To the extent permitted by law, the provider is not liable for indirect, incidental, or consequential damages arising from use of, or inability to use, the app. Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer-protection rights and liability for death or personal injury caused by negligence.
10. Governing law
These Terms are governed by the laws of Austria, without regard to conflict-of-law rules and without prejudice to any mandatory consumer-protection rights of your country of residence.
11. Changes
We may update these Terms; continued use after changes take effect constitutes acceptance. Material changes will be reflected here with a revised date.
